Chapter I General Provisions
Article 1 Toregulatethe management of students at Chongqing Normal University (hereinafter referred to as the "University"), maintainthenormal order of academic activities and living, safeguard students' legitimate rights and interests, and cultivate socialist builders and successors with well-rounded development in moral, intellectual, physical, aesthetic and other aspects, these provisions are formulated in accordance with relevant laws and regulations such as the Education Law and the Higher Education Law, as well as the Regulations on the Management of Students in Regular Institutions of Higher Education (Order No. 41 Issued by the Ministry of Education), the Charter of Chongqing Normal University and the Regulations of Chongqing Normal University on Students Management (Revised) (CNUF[2017] No. 62).
Article 2 These provisions apply to the management of all postgraduate, undergraduate, and junior college (higher vocational) students (hereinafter referred to as "students") enrolled in regular higher education programs at Chongqing Normal University.
Article 3 The University imposes disciplinary actions in accordance with the principle of combining education with punishment, ensuring that the disciplinary actions are proportionate to the nature of the violation and the severity of the fault. The disciplinary actions shall be imposed in a manner that is evidence-based, clearly justified, accurately categorized, procedurally fair, and suitably proportioned.
Chapter II Types of Disciplinary Actions and Their Application
Article 4 Students who violate applicable laws and regulations, these regulations, or the University's disciplineswill be subject tocriticism and education. Depending on the severity of the case, the following disciplinary actions may be imposed:
(1) Warning;
(2) Serious Warning;
(3) Demerit;
(4) Academic probation;
(5) Expulsion fromthe University.
Article 5 Students who meet any of the following conditions maybe subject toa lighter disciplinary action:
(1)Truthfully and proactively acknowledging their violations in a cooperative manner, and actively cooperating with relevant departments during the investigation;
(2) Having performed meritorious deeds.
Article 6 Students who meet any of the following conditions will be subject to a heavier or aggravating disciplinary action:
(1) Threatening or retaliating against the informants, witnesses, or other relevant personnel;
(2) Committing violations twice;
(3) Coercing, enticing, or persuading others to violate rules;
(4) Deliberately hiding violations, destroying evidence, or obstructing the disciplinary process.
Article 7 Disciplinary actions, except for expulsion, are subject to a specified validity period: Warning - 6 months; Serious Warning - 8 months; Demerit - 10 months; Academic Probation - 12 months. The period begins on the date the University issues the disciplinary decision and will expire in accordance with the University's established procedures. If a student's remaining enrollment period is shorter than the specified period of a disciplinary action, the resolution shall be made through a special meeting at the University. During the validity period, students subject to disciplinary actions are no longer eligible for awards, scholarships, student leadership positions, and Party/League organization training programs, and shall not receive any assistance beyond emergency relief for special difficulties.
After the specified period ends, the student shall submit a written application for the termination of the disciplinary action. Once the disciplinary action is terminated, the student regains eligibility for awards, recognition, and other rights.
Chapter IIIViolations of Disciplineand Disciplinary Actions
Article 8 Students who violate national laws and regulationswillbe subject to the following disciplinary actions, depending on the severity of the case:
(1) Students who violate the Constitution, oppose the Four Cardinal Principles, undermine stability and unity, or disturb social order shall be expelled;
(2) Students who violate national laws and commit a criminal offense shall be expelled;
(3) Students who receive warnings or fines for violating public security regulations shall be subject to a Serious Warning or a more serious disciplinary action; those placed under administrative detention shall be subject to Probation or a more serious disciplinary action. Those who commit grave public security violations shall be expelled.
Article 9 Students who deliberately damage public or private property shall, in minor cases, be subject to disciplinary actions ranging from a Warning to a Demerit, and shall compensate for the losses. In serious cases or where the conduct is of an egregious nature, Probation or a more serious disciplinary action shall be imposed and the losses shall be compensated.
Article 10 Students who engage in theft, fraud, receiving or selling stolen property, or misappropriation of public funds shall, in addition to returning stolen funds or property, be subject to the following disciplinary actions:
(1) Students who steal property or misappropriate public funds shall, in minor cases, be subject to a Serious Warning, and in serious cases, be given a Demerit or more serious disciplinary action;
(2) Students who receive or sell stolen property shall be subject to a Warning or more serious disciplinary action, depending on the severity of the case;
(3) Students who commit fraud shall be given a Demerit or more serious disciplinary action, depending on the severity of the case.
Article 11 Students whose theses or publicly published research results involve plagiarism, falsification, or fabrication shall, depending on the severity of the case, be given disciplinary actions ranging from a Demerit to expulsion. Those who engage in ghostwriting or buy and sell academic papers shall be expelled.
Article 12 Students who conceal, open others' mail without permission, or destroy it shall be subject to a Serious Warning or more serious disciplinary action. Those who forge, alter, or falsify certificates, proofs, or other materials shall be given a Demerit or more serious disciplinary action, depending on the severity of the case.
Article 13 Students who provide false testimony shall be subject to the following disciplinary actions:
(1) Students who provide false testimony for others and obstruct investigationsand therebycauseadverse consequences shall be subject to a Serious Warning or Demerit;
(2) Students who deliberately falsify facts or form collusive alliances shall be given a Demerit.
Article 14 Students who plan, provoke, or participate in fights or other disruptive behaviors shall be subject to the following disciplinary actions:
(1) Students who plan, provoke, participate in, or incite fights shall be subject to disciplinary actions ranging from a Serious Warning to a Demerit in minor cases and from probation to expulsion in serious cases;
(2) Students who engage in group fights with weapons or cause disturbances shall be subject to disciplinary actions ranging from probation to expulsion;
(3) Students who provide weapons shall be subject to disciplinary actions ranging from a Demerit to expulsion, depending on the severity of the case and consequences;
(4) Students who provoke the incidents shall be given a Warning or Serious Warning;
(5) Students who disrupt public order and ignore Warnings, or who harm others verbally or otherwise, shall be given disciplinary actions ranging from a Warning to a Demerit, depending on the severity of the case;
(6) Students who illegally possess or carry controlled knives shall be given a Serious Warning when discovered.
Article 15 Students who gamble, engage in disguised gambling, or provide gambling tools or venuesshallbe subject to the following disciplinary actions, depending on the severity of the case:
(1) Students who provide venues or gambling toolsshallbe subject to a Warning or a Serious Warning;
(2) Students who gamble or engage in disguised gambling using cash, notes, or physical items as stakesshallbe subject to a Demerit or more serious disciplinary action, depending on the severity of the case;
(3) Students who gamble or engage in disguised gambling onlineshallbe subject to a Demerit or more serious disciplinary action, depending on the severity of the case.
Article 16 Students who violate the University's fire safety regulations, damage fire-fighting equipment, use flammable or explosive materials, or engage in other prohibited activities that cause a fire shall, in addition to compensating for part or all of the economic losses, be subject to disciplinary actions ranging from a Demerit to Expulsion.
Article 17 Students who violate the dormitory management regulations shall be subject to the following disciplinary actions, depending on the severity of the case:
(1) Students whomake unauthorized electrical/network connections, or use prohibited electrical appliances in the dormitory shall be subject to disciplinary actions ranging from a Serious Warning to probation;
(2)Studentswhostay overnight in dormitories of the opposite sex, or allow members of the opposite sex to stay in their dormitory, shall be subject to a Demerit or more serious disciplinary action;
(3) Students who keep pets in the dormitory and refuse to correct despite education shall be subject to disciplinary actions ranging from a Warning to a Demerit;
(4)Studentswho arbitrarily change, occupy, or rent dormitories or beds and refuse to correct despite education shall be subject to a Warning or Serious Warning;
(5)Studentswho litter or improperly dump waste in the dormitory, seriously affecting dormitory hygiene, and refuse to correct despite education shall be subject to a Warning or Serious Warning;
(6)Studentswho fail to return to the dormitory on time without valid reasonsand therebycauseadverse consequences shall be subject to disciplinary actions ranging from a Warning to a Demerit. Those who forcibly enter a dormitory without permission shall be subject to a Serious Warning or Demerit;
(7)Studentswho violate other dormitory management regulations, causing negative consequences, and refuse to correct despite education, shall be subject to a Warning or more serious disciplinary action.
Article 18 Students who damage the reputation of college students and violate public morality, resulting in negative social impact, shall be subject to the following disciplinary actions:
(1)Studentswho engage in or participate in illegal business activitiesshallbe subject to disciplinary actions ranging from a Demerit to Expulsion, depending on the severity of the case;
(2)Studentswho insult or harm others, or interfere with others' normal study or daily life,shallbe subject to disciplinary actions ranging from a Warning to a Demerit in minor cases. Probation or a more serious disciplinary actionshallbe applied in serious cases;
(3)Studentswho exhibit uncivilized behavior in classrooms, dining halls, dormitories, or other public areas of campus, damaging the reputation of college students,shallbe subject to disciplinary actions ranging from a Warning a Demerit in minor cases. Probation or a more serious disciplinary actionshallbe applied in serious cases that cause significant negative impact.
Article 19 Students who watch, read, copy, or distribute obscene materials or illegal publicationsshallbe subject to the following disciplinary actions:
(1)Studentswho read illegal publications, obscene books, or watch obscene audio-visual content and refuse to correct despite educationshallbe subject to disciplinary actions ranging from a Warning to a Demerit;
(2)Studentswho produce, copy, or distribute illegal publications or obscene materialsshallbe subject to a Demerit or more serious disciplinary action.
Article 20 Students who sell, transport, possess, produce or use illegal drugsshallbe expelled.
Article 21 Students who coerce, intimidate, falsely accuse, or slander others or organizationsshallbe subject to disciplinary actions ranging from a Warning to Expulsion, depending on the severity of the case.
Article 22 Students who disrupt the normal teaching, campus life, or public area management, seriously affecting others' study, work, or life,shallbe subject to the following disciplinary actions, depending on the severity of the case:
(1)Studentswho make noise, throw objects, or refuse to listen to dissuasion during normal study, work, or rest hoursshallbe subject to disciplinary actions ranging from a Warning to a Demerit in serious cases;
(2)Studentswho are drunk, make disturbances, or cause incidentsshallbe subject to disciplinary actions ranging from a Warning to a Demerit, depending on the severity of the case;
(3)Studentswho post, hang, or place items on campus without approval, and refuse to correct despite education,shallbe subject to disciplinary actions ranging from a Warning to a Demerit;
(4)Studentswho dump waste, throw, or burn items in public areas on campus, causing negative impact,shallbe subject to disciplinary actions ranging from a Warning to a Demerit;
(5)Studentswho cause disruptions in public areas such as classrooms, meeting venues, dining halls, or examination venues, and refuse to listen to
dissuasion,shallbe subject to disciplinary actions ranging from a Warning to Probation, depending on the severity of the case;
(6)Studentswho obstruct the University or its staff from performing official dutiesshallbe subject to disciplinary actions ranging from a Warning to a Demerit in serious cases; those who harbor individuals violating laws or regulationsshallbe subject to disciplinary actions ranging from a Warning to Expulsion, depending on the severity of the case;
(7) No individual or organization is allowed to carry out religious activities on campus. Those in violation of this ruleshallbe subject to a Serious Warning or more serious disciplinary action, depending on the severity of the case;
(8)Studentswho engage in illegal pyramid schemes, cult or superstitious activitiesshallbe subject to a Serious Warning or more serious disciplinary action, depending on the severity of the case;
(9)Studentswho engage in other misconduct thatdisruptsthe normal teaching, campus life, or public area managementshallbe subject to a Warning or more serious disciplinary action, depending on the severity of the case.
Article 23 Students who violate national or the University's regulations, endangering public safety,shallbe subject to disciplinary actions ranging from a Serious Warning to Expulsion,depending on the severity of the case.
Article 24 Students shall comply with national and the University's regulations regarding internet use. They shall not access illegal websites, share illegal content in text, audio or video form, fabricate or spread false or harmful information, or hack into others' computer or mobile networks. Those who violate these regulations and cause negative impactshallbe subject to a Warning or more serious disciplinary action, depending on the severity of the case.
Article 25 Students who fail to attend classes without authorization for the following class hours in a single semestershallbe subject to the following disciplinary actions:
(1) A cumulative total of 8–16 class hours: Warning;
(2) A cumulative total of 17–30 class hours: Serious Warning;
(3) A cumulative total of 31–39 class hours: Demerit;
(4) A cumulative total of 40 class hours or more: Probation.
Article 26 Students who violate assessment rules, cheat, or miss examsshallhave their grades handled according to the course assessment regulations and be subject to the following disciplinary actions:
(1)Studentswho violate assessment rulesshallbe subject to a Warning or Serious Warning, depending on the severity of the case.
(2)Studentswho cheat in assessmentsshallbe subject to disciplinary actions ranging from a Demerit to Expulsion, depending on the severity of the case. Expulsionshallbe imposed for any of the following violations:
1. Taking exams for others or having others take exams for oneself;
2. Organizing cheating;
3. Using communication devices or other tools to cheat;
4. Selling exam papers or answers for profit;
5. Stealing exam papers or contents;
6. Other serious cheating or disruption of exams.
(3)Studentswho cheat during the exams organized by the state or Chongqing municipalityshallbe subject to the same disciplinary actions as for course assessment violations.
(4) Undergraduate and junior college(higher vocational) students who miss examsshallhave their grades handled according to the course assessment regulations, and be subject to the following disciplinary actions, depending on the severity of the case. A course retake may be permitted based on their attitude.
1. First absence: criticism and education; Two absences during their study at the University: Warning.
2. Two absences in a semester or three absences during their study at the University: Serious Warning.
3. Three absences in a semester or four absences during their study at the University: Demerit.
4. Four or more absences in a semester or five absences during their study at the University: Probation.
5. Six or more absences during their study at the University: Expulsion.
(5) Graduate students who miss examsshallhave their grades handled according to the course assessment regulations, and be subject to the following disciplinary actions, depending on the severity of the case:
1. Absence from one non-degree course in a semester: Warning.
2. Absence from two non-degree courses or one degree course in a semester: Demerit.
3. Absence from three non-degree courses or two degree courses in a semester: Expulsion.
Article 27 Students who fail to follow the University rules or activity requirements during teaching, social practice, on-campus or off-campus work-study activities, club activities, holidays, or daily life, causing negative impact or serious consequences,shallbe subject to the relevant provisions.
Chapter IV Approval Authority and Procedures for Disciplinary Actions
Article 28 Disciplinary actions for graduate, undergraduate, andjunior college(higher vocational) students are as follows:
Studentswho violate academic disciplines will be handled by the Graduate School or the Office of Academic Affairs, whilestudentswho violate public security administration, fire safety, or other related regulations will be jointly investigated by the Security Office and their schools, with conclusions and preliminary recommendations submitted to the Graduate School or the Office of Student Affairs for handling. Similarly,studentswho violate the dormitory management regulations will be jointly investigated by the relevant dormitory management department, the Security Office, and their schools, with conclusions and preliminary recommendations submitted to the Graduate School or the Office of Student Affairs for handling. Other types of violations will be managed by the Office of Student Affairs or the Graduate School as appropriate.
Disciplinary actions such as Warning, Serious Warning, and Demerit shall, after investigation and verification, be reviewed by the school's Party and Government Joint Meeting, with written recommendations submitted to the Graduate School, the Office of Academic Affairs, and the Office of Student Affairs for decision. Disciplinary actions such as Probation and Expulsion shall, after investigation and verification, be reviewed by the school's Party and Government Joint Meeting, with written recommendations submitted to the Graduate School, the Office of Academic Affairs, and the Office of Student Affairs for deliberation and to the President's Office Meeting for decision.
Article 29 For violations involving students from a single school, the investigation will be organized by the student's school in cooperation with relevant functional departments. For violations involving students from two or more schools, the investigation will be conducted by relevant functional departments in cooperation with the involved schools. The investigation may also be directly organized by the Graduate School, the Office of Academic Affairs, the Office of Student Affairs, the Security Office, and other departments, if needed.
Article 30 The investigation of violations shall generally be completed within 15 days. In cases that are particularly complex or involve a broad scope, where the facts cannot be promptly ascertained, the matter may be handled once the facts have been clarified, subject to approval by the competent authority.
Article 31 Before a disciplinary action decision against a student is made, the student must be informed of the facts, reasons, and basis for the proposed disciplinary action, as well as their right to state their cases and defend themselves. The student's statements and defenses shall be fully heard.
Article 32 A legality review must be conducted before a decision to expel a student is submitted to thePresident's Office Meetingfor approval.
Article 33 The Office of Academic Affairs, the Office of Student Affairs, and the Graduate School shall complete the approval process within 15 days after receiving the preliminary recommendations from the school. If the case is too complex and a conclusion cannot be reached within the specified period, the timeline may be extended by 15 days with the approval of the University.
Article 34 A written decision shall be issued for any disciplinary action imposed on a student, which shall include the following details:
(1) Basic information of the student, including name, gender, date of birth, place of origin, ID number, ethnic group, school, major and grade, student ID number, etc.;
(2) The facts and evidence supporting the disciplinary action;
(3) The type, basis, and duration of the disciplinary action;
(4) Ways to appeal and the time limit;
(5) Other necessary details.
Article 35 All written decisions shall be issued in the name of the University, and relevant materials shall be kept under centralized administration.
Article 36 The written documents including the decision and notice of a disciplinary action shall be delivered directly to the student. If the student refuses to receive them, they may be served by leaving them at the student's place. If the student has left the University, the documents may be delivered by mail. If the student is otherwise unreachable, the documents may be posted on the University's website or announced via news media.
Article 37 Any student who disagrees with a disciplinary action may submit a written appeal to the University's Student Appeal Handling Committee within 10 days of receiving the written decision. The appeal shall be handled in accordance with the University's Student Appeal Procedures.
Chapter V DisciplinaryAction Enforcement
Article 38 Termination of thesanction period:
(1) If asanctioned student exhibits no violations of laws, regulations, or rules and behaves properly during the sanction period, he/she shall submit a written application to the relevant functional department for termination of the sanction period within 15 days before its expiration;
(2) The student's school shall provide recommendations to the relevant functional department based on the student's actual conduct during the sanction period. The relevant functional department shall make a decision and issue a written decision within 15 days of receiving the school's recommendations.
Article 39 Graduates must leave the University in a timely and orderly manner. Any violations committed by a graduate during his/her enrollment, if discovered after leaving the University, shall still be handled in accordance with these provisions. The disciplinary action decision and relevant materials shall be sent to the unit where the graduate's file is maintained.
Article 40 Students who have been expelled must leave the University within 10 days from the date the expulsion decision is delivered. The Security Office may take appropriate actions if they delay without valid reasons.
Expelled students will be provided with a certificate of study. Their academic records will be returned tothe localities oftheir family residence or household registration, and their household registration shall be transferred tothe places oftheir original household registration orlocalities of theirfamily residence in accordance with relevant national regulations.
Article 41 The University shall ensure that all disciplinary action materials and records concerning the termination of the sanction period are completely and accurately filed in both the University's official archives and the student's personal file.
Chapter VI Supplementary Provisions
Article 42 In emergencies involving situations not covered by these provisions, the University's relevant functional departments may propose handling recommendations in accordance with the relevant principles and spirit of these provisions to maintain the normalorder of academic activitiesand livingat theUniversity.
Article 43 These provisions also apply to students pursuing continuing higher education at the University, and to students from Hong Kong, Macao, Taiwan and overseas.
Article 44 These provisions are interpreted by the Office of Student Affairs (Student Work Department), the Graduate School (Graduate Work Department), and the Office of Academic Affairs.
Article 45 These provisions come into effect on September 1, 2017 andsimultaneously replacethe former Provisions of Chongqing Normal University on Disciplinary Actions for Violations of Discipline by Students (CNUF[2010] No. 59). In case of discrepancies between other relevant documents and these provisions, these provisions shall prevail.
