Measures for Handling Students' Appeals at Chongqing Normal University (Revised)

Chapter I General Provisions

Article 1 To regulate the management of students at Chongqing Normal University (hereinafter referred to as "the University"), safeguard students' legitimate rights and interests, and strengthen supervision over student-related handling or disciplinary action, these measures are formulated in accordance with relevant laws and regulations such as the Education Law and the Higher Education Law, as well as the Regulations on the Management of Students in Regular Institutions of Higher Education (Order No. 41 Issued by the Ministry of Education), the Charter of Chongqing Normal University and the Regulations of Chongqing Normal University on Students Management (Revised) (CNUF[2017] No. 62).

Article 2 These measures apply to the handling of appeals filed by graduate, undergraduate, and junior college (higher vocational) students (hereinafter referred to as "students")enrolled in regular higher education programs at the University.

Article 3 The University has established a Student Appeal Handling Committee, comprising the University's leadership, heads of relevant functional departments, faculty and student representatives, and the head of the legal affairs office. The Committee has an office in the University's Party and Administration Office, responsible for receiving students' appeals and coordinating their handling with the relevant units.

Article 4 Students who disagree with the University’s handling or disciplinary action decisions may file an appeal with the Student Appeal Handling Committee, following the principles of seriousness, objectivity, honesty, and good faith.

Article 5 Students' appeals shall be handled in accordance with the principles of fairness, justice, and transparency, with all procedures conducted properly and in accordance with the law.

Article 6 Members of the Student Appeal Handling Committee who neglect their duties or engage in malpractice shall be held accountable by the University's Disciplinary Inspection and Supervision Department.

Chapter II Acceptance of Appeals

Article 7 Students who disagree with the University's handling or disciplinary action decisions may submit an appeal to the Student Appeal Handling Committee within 10 days from the date the decision is received. If the decision does not specify the appeal deadline, it shall be calculated from the date the student becomes aware or should have become aware of the decision, but in no case shall it exceed six months.

Article 8 When submitting an appeal, students shall submit a written application to the Student Appeal Handling Committee, in which the statement should address the relevant matters contained in the handling or disciplinary action decision.

Article 9 The Committee shall, upon receipt of a student's appeal, determine whether to accept it, and if the appeal is rejected, the student shall be promptly notified of the reasons.

Article 10 The Committee shall not accept an appeal under the following circumstances:

(1) The appeal exceeds the permitted scope;

(2) The appeal is submitted after the deadline;

(3) The appeal repeats matters that have already been concluded in a previous appeal review;

(4) The appeal has already been submitted to the Chongqing Municipal Education Commission or for administrative reconsideration;

(5) The appeal has already been brought before judicial authorities.

Chapter III Handling of Appeals

Article 11 TheStudent Appeal Handling Committeeshall review students' appeals, issue a review decision within 15 days from the date the written appeal is received, and notify the appellant. In complex cases where a decision cannot be made within the prescribed period, an extension of 15 days may be approved by the University's leadership. If deemed necessary, the Committee may recommend temporarily suspending the implementation of the relevant decision.

Article 12 The Committee shall review relevant materials and investigate personnel involved in the appeal. The investigation may be carried out in various forms, including written examination, committee deliberations, and field visits.

Article 13 The Committee shall make one of the following decisions based on the review conclusions and the circumstances:

(1) If the facts are clear, evidence is sufficient, the characterization is accurate, the procedures are proper, and the handling or disciplinary action is appropriate, the decision shall be upheld;

(2) If the facts are unsubstantiated, or the decision was made beyond the authority or in violation of higher-level regulations, the Committee may suggest revoking the decision;

(3) If the facts are clear but circumstances are misjudged, the characterization is inaccurate, or the basis for the decision is incorrect, the Committee may suggest modifying the decision;

(4) If the facts are unclear, evidence is insufficient, or procedures and authority have been violated, the Committee may suggest modifying the decision.

Article 14 In cases where it is recommended to uphold the original handling or disciplinary action, the Student Appeal Handling Committee shall submit the review opinion to the relevant functional department under the original authority for handling.

In cases where it is recommended to revoke or modify the original decision, the Committee will advise the relevant functional department to examine the case and submit it to the President's Office Meeting or another special meeting authorized by the President for decision.

Article 15 Students who disagree with the University's review decision may submit a written appeal to the Chongqing Municipal Education Commission within 15 days from the day the review decision is received.

Article 16 Before a handling decision is made, students may withdraw their appeal in writing. Upon receiving the withdrawal request, the Committee shall suspend the appeal process.

Article 17 A student who fails to submit a written appeal within the designated period after receiving the handling or disciplinary action decision shall be deemed to have waived the right to appeal, and the University will no longer accept the appeal.

Chapter IV Supplementary Provisions

Article 18 These measures also apply tostudents pursuing continuing higher education at the University, and to students from Hong Kong, Macao, Taiwan and overseas.

Article 19 The Student Appeal Handling Committee, as authorized by the University, shall interpret these measures.

Article 20 These Measures come into effect on September 1, 2017 and simultaneously replace the former Measures for Handling Students' Appeals at Chongqing Normal University (CNUF [2010] No. 60).
