Measures for Work-study Management of International Students in Higher Education Institutions

Article 1 To regulate work-study activities of international students in higher education institutions and boost educational opening-up, these Measures are formulated in accordance with the Exit and Entry Administration Law of the People's Republic of China, the Regulations of the People's Republic of China on Administration of the Entry and Exit of Foreigners, the Regulations on Students Management in Regular Institutions of Higher Education, the Administrative Measures for the Enrollment and Cultivation of International Students by Schools, and other regulations.

Article 2 These Measures are applicable to higher education institutions providing higher education leading to academic degrees (hereinafter referred to as "schools").

Article 3 The term "work-study" refers to activities conducted by international students under the organization and management of their schools during their spare time to earn lawful remuneration to improve their study and living conditions. These activities do not include teaching internships and social practices organized by the schools as part of their teaching plans.

Article 4 On- and off-campus work-study activities for international students shall be carried out under the unified leadership and coordinated arrangements of the schools, subject to adequate capacity of the international students after fulfilling academic requirements, voluntary application, prior consideration of students in financial need, and compliance with laws and regulations. Relevant implementation rules shall be developed by schools to specify their own work-study measures for international students and define the responsibility and authority of the corresponding internal functional departments.

Article 5 In principle, international students’ participation in work-study activities on or off campus shall generally not exceed 8 hours per week or 40 hours per month during academic terms, or 16 hours per week or 80 hours per month during winter and summer vacations.

Article 6 Schools may not arrange or authorize any student to engage in toxic, harmful, or dangerous production work, and must ensure that international students taking part in work-study activities have purchased insurances that fully cover their work-study activities.

Article 7 For on-campus work-study positions, priority should be given to roles such as teaching assistants, research assistants, administrative assistants, and public service positions within the institution. Positions should be designed to meet student needs while avoiding interference with normal study time. The remuneration for on-campus work-study activities shall be funded and arranged by the institution.

Article 8 Remuneration for international students’ work-study activities shall be paid as follows: For regular on-campus positions, remuneration shall be paid on a monthly basis, and the remuneration for 40 working hours per month shall be basically no less than the minimum standard for subsistence of local residents, subject to appropriate adjustments.

For temporary on-campus positions, remuneration shall be paid on an hourly basis, and the hourly rate may be properly determined by reference to the minimum hourly wage standards set by the local governments where the schools are located.

For off-campus work-study positions, remuneration shall not be lower than the minimum wage standard set by the local governments or relevant authorities where the schools are located; the specific amount shall be agreed upon between the employer and the student, and specified in the employment agreement.

Article 9 An international students intending to engage in any off-campus work-study activity must:

(1) Be at least 18 years old and meet the physical requirements for the work-study position;

(2) Hold a valid residence permit for studying in China with more than six months of validity remaining;

(3) Abide by Chinese laws and regulations, as well as school rules and regulations, maintain good conduct and performance, and have no record on criminal offenses or disciplinary violations;

(4) Be an undergraduate student, graduate student, visiting student or research scholar who has studied non-stop in the school for more than one year;

(5) Meet the school’s requirements regarding academic progress and attendance;

(6) Satisfy any other conditions specified by the school.

Article 10 The student shall submit a copy of the agreement made with an employer to the school for record, along with a unilateral letter of commitment regarding the assumption of risks and other related matters.

Article 11 International students engaging in off-campus work-study activities must apply, by presenting relevant agreements, certification letters from their schools and other relevant materials within ten days of engagement in accordance with applicable regulations, to the departments of exit-entry administration under the local public security authorities for an endorsement on their residence permits, indicating the employers, duration of the work-study activities and other related information. Those whose residence permits contain no such work-study endorsements may not take part in off-campus work-study activities.

An international student who experiences a change of the employer or duration of any off-campus work-study activity shall apply, by presenting the new agreement and certification letter from the school within ten days of the change, to the department of exit-entry administration under the local public security authorities for an update to the endorsement information.

An international student who ceases engagement in any off-campus work-study activity for the termination of the employment agreement by the employer, must, within ten days of the cessation, submit a written report to the school and apply to the department of exit-entry administration under the local public security authorities for an update to the endorsement information.

Article 12 Students may engage in work-study activities only within the administrative areas of the cities where their schools are located. For any student, the duration of any work-study activity in each application shall not exceed the validity period of the student’s residence permit for study, and the maximum duration shall not exceed one year.

Article 13 Schools shall disqualify international students for work-study activities and immediately report to the departments of exit-entry administration under the local public security authorities if the international students:

(1) Have completed their studies, left the schools without graduation, suspended studies or dropped out;

(2) Have violated any state laws and regulations or relevant management rules of the schools;

(3) Have any poor moral conduct or violation of public order and good customs, causing negative impact;

(4) Are subject to any other circumstance rendering them unsuitable as the schools deem for continued work-study, such as work-study activities negatively affecting academic performance.

Article 14 International students engaging in work-study activities beyond the approved range of positions or the permitted lengths of duration will be subject to measures implemented by the departments of exit-entry administration under the local public security authorities in accordance with the law.

Article 15 Departments of educational administration at the provincial level shall act in coordination with local departments of public security, immigration administration, and human resources and social security to oversee and regulate work-study activities for international students within their administrative areas, guide schools within their administrative areas in developing and improving detailed implementation rules for work-study programs of international students based on the realities of the schools and the local conditions, and dynamically manage the range of eligible work-study positions in accordance with applicable local regulations.

Article 16 Schools shall diligently assume their primary responsibility for the management of work-study activities for international students, and intensify regular education, inspections, and follow-up management to ensure that on- and off-campus work-study activities are carried out in a regulated manner.

Article 17 These Measures shall take effect from the date of issuance.
